Important Information

Smarty Party will at all times endeavour to provide you with your Party Supplies within 10 working days, subject to all Items being in stock.

Handmade Items require a minimum of 3 weeks notice.

Food Items & Confectionery Items require a minimum of 3 weeks notice.

Large Quantity Orders require 4 weeks notice.

Smarty Party will arrange to forward your Party Packages using either Australia Post and/or a Courier service. You may be required to sign for the Package as proof of delivery. Delivery &/or Postage Fees will be calculated on total weight and charged after processing your order.

Party Supplies : Up to 10 working days
Food Items : 2 weeks notice required
Courier Fees : Payable in addition to your Total Order Sum.

We accept all orders by payment with Visa, Mastercard and American Express. A surcharge of 3.25% plus GST is payable to Smarty Party when using an American Express credit card. Credit cards payments will be processed on the day your order is placed. Goods will be forwarded to you once full payment has been processed.

Bank cheque, money orders & direct deposit are also accepted.

The Total Amount of your Order is to be paid at the time of ordering. Smarty Party does not accept deposits or part payments for the purchase of any goods.

In addition, as set out in respect of Postage & Delivery, Postage and/or Delivery Fees will be calculated on total weight and the final delivery destination and will be charged to you after processing your order. Due to the perishable and fragile nature of food items or food related items, if your order contains such items, Smarty Party will use a Courier Service for delivery of your order to you at your nominated address on a mututally agreed date. All orders delivered to you by Courier Service are to be received by you and signed for you on the agreed date.

All prices are quoted in Australian Dollars and are inclusive of GST (Goods and Services Tax) at the applicable rate. Our prices quoted in our website are current, however they may vary from time to time as determined by Smarty Party. There is no minimum Total Order value.

In these Terms and Conditions “Smarty Party” means Smarty Party Events Pty Ltd ABN 98 116 580 050 trading as Smarty Party and “you” means the person ordering items from Smarty Party.

Once your order is placed, Smarty Party will accept that Order as final and changes or cancellations cannot be made to the Order. By placing an Order, you agree to all the Terms and Conditions as advised by Smarty Party.

Should a product not be available at the time of placing your order, Smarty Party reserves the right to contact you and advise you of your options.

If any item ordered is not in stock at the time of delivery to you, Smarty Party may in its absolute discretion:

1. deliver the balance of the order;
2. forward the missing item when it comes into stock;
3. supply an agreed substitute for the item; or
4. refund you the price of the missing item

Items of a handmade nature may have slight variations between each individual item. Smarty Party may at it’s absolute discretion, replace any component with a similar alternative.

Due to the perishable and fragile nature of food items or food related items, Smarty Party will use a Courier Service for delivery to you at your nominated address on a mutually agreed date. All orders for perishable and or food related items are to be received by you and signed for by you on the agreed date. Courier fees and/or postage fees will be charged to you after your Order is processed.

**Birthday Cakes, Cupcakes and Boxed Cookies will only be delivered in the Sydney Metropolitan Area unless specifically arranged with Smarty Party.

Not all items are for sale purposes. Some may be used as stylist own props and therefore cannot be purchased.

Smarty Party provides an undertaking to all our customers that goods leave our premises and/or the premises of our preferred suppliers in 100% perfect condition. Should those goods not be received by you in 100% perfect condition, then it will be considered the responsibility of the Carrier and should be pursued directly with them.

Any claim of damage to or shortfall in products received must be reported to Smarty Party in writing within 36 hours after receipt of the goods. All returns must be pre-approved by telephoning Smarty Party.

Merchandise WILL NOT be accepted as returned if it is not in it’s original unopened packaging.

Once goods are dispatched, there will be strictly No refunds other than for defective merchandise.

Please be aware and read the following Terms and Conditions before placing any orders:

* No refunds, returns or cancellations for Change of Mind or other for other “like” reasons once your Order is placed.

*No refunds, returns or cancellations on merchandise that is to be worn or deemed able to be worn

*Postage will not be reimbursed or refunded in any circumstance where items are returned.

Smarty Party is not responsible for nor does it give any warranty in respect of any materials, food stuffs, drinks or other supplies which give rise to:

1. any adverse affect on any person due to allergy or intolerant reaction arising from that person’s consumption of any food or drink supplied by Smarty Party;
2. any damage suffered by any person using any materials supplied by Smarty Party;
3. any damage suffered by any person in the conduct of any game or activity supplied by Smarty Party;
4. any damage suffered by any person caused by any other person, including clowns or entertainers, provided by Smarty Party; or
5. any loss or damage to any material and goods including food and drink agreed to be supplied by Smarty Party, which damage occurs in transit, during delivery or in any other manner after the material has left the offices of Smarty Party.

You the customer hereby indemnify Smarty Party against all claims actions suits demands or costs made on or against Smarty Party by any person arising from the provision of any goods and materials including food and drink supplied by Smarty Party.

Smarty Party reserves all rights under trade mark and copyright law.
